Terms and Conditions

These terms and conditions shall be amended from time to time, as they apply to all our services directly or indirectly that are made available online or in publications, through any device, by email or by telephone. By accessing, browsing, and using our website or any of our applications through whatever platform and/or by completing a reservation and required payments. By doing so, you acknowledge to have read and understood these Terms and Conditions, agreeing and accepting as set out below.

WEB COMMUNICATIONS

We request that you do not send us any confidential information or messages by internet or email of any type, including but not limited to, transaction instructions that include credit cards, wire transfers, routing, banking or any other confidential information. Customers that choose to send information via internet or emails that contain private and/or personal information do so entirely at their own risk.

RESERVATIONS and BOOKINGS

All reservations must be guaranteed by a valid credit card at time of booking. A deposit equal to 50% of your entire stay will be charged at time of booking. The remaining balance will be charged 30 days prior to your expected arrival (bookings within the expected arrival date shall be paid in full). This nonrefundable payment will automatically debit the credit card. No booking shall be treated as confirmed until deposit described in this paragraph has been provided and booking confirmation has been issued.

Rates are subject to applicable taxes.

RESERVATIONS/RENTALS

Primary Guest shall make their reservations in good faith for use only by you, your invited guests and/or others on whose behalf that you are authorized to act, and not for any other purposes, including but not limited to reselling, assigning or posting on third party websites, or making speculative, false or fraudulent reservations, or any reservations in anticipation for third party use. We reserve the right to in our sole discretion for any reasons to modify or cancel any reservations, including but not limited to, where it appears that a customer has engaged in fraudulent, inappropriate activity or under other circumstances where it appears that the reservation contains or resulted from a mistake or error, even if such mistake or error is ours.


To contest the cancellation of a booking or freezing/closure of an account, please contact management at Blue Spruce Resort.

CHECK-IN/ CHECK-OUT REQUIREMENTS

In the interest of fraud prevention and resort security, at the time of check-in, guests may be required to confirm their identity by providing their booking reference, identity byway of identification card/driver’s license, and a valid credit card. The above information may be requested for each member of your party over the age of 18. We do, however, reserve the right to refuse entry to persons who cannot provide the criteria listed above. Unless otherwise stated on the booking confirmation, guests may check-in at any time after 4:00 pm on the scheduled day of arrival. All rooms that have been prepaid at the time of booking will be held until 11:59 pm on the scheduled day of arrival unless otherwise agreed upon directly with resort management. On the day of departure, all guests are to vacate their rooms by 11:00 am (unless a later departure is agreed upon at the time of your booking). Late check-out after this time can be requested, subject to availability, and will be charged at the discretion of resort management. Rooms are subject to maximum occupancy rules set by Blue Spruce Resort. Please contact Blue Spruce Resort management if you have additional questions about maximum occupancy rules.

DAMAGES

Blue Spruce Resort reserves the right, and you hereby authorize us to charge your credit card, for any damages incurred to your cottage, studio, and/or suite and surrounding property during your stay (including without limitation to specialized cleaning charges if required) or for any items that are missing upon your departure.

BEHAVIOUR

Guests must conduct themselves appropriately and respect the property of Blue Spruce Resort, its employees, other guests, and the health and safety of others. Guests are required not to disrupt the comfort and enjoyment of other guests, the operations, or cause offence to other guests or members of our staff. In the event a guest behaves inappropriately, we reserve the right to refuse accommodation and remove you and members of your party from the resort if, in our reasonable opinion, we shall have no obligation to refund you for lost accommodation and any other loss or expense incurred.

SMOKING

Guests are not permitted to smoke, including vaping or smoking/vaping any substance, in any resort units and/or buildings. Blue Spruce Resort reserves the right to charge a $1000 cleaning fee if it is determined that there has been smoking/vaping within a unit(s).

SERVICE ANIMALS

We welcome animals of service in all parts of our resort that are open to the public. Service animal documentation is required. All damages incurred to the units or property will be charged to the guest accordingly. The guest acknowledges that a $35/night pet fee will be required at the time of booking. The service animals are bound by the same Terms and Conditions and set in the Behaviour item.

PETS

We currently have a no pet policy in place, excluding service animals.

WEBSITE INFORMATION

All reasonable efforts have been taken to ensure the accuracy of information on the resort website. Information provided on the resort website will be amended from time to time without notice.

DISCLAIMER AND LIMITATION OF LIABILITY AND WAIVER

We have provided you the Site and the Application in the condition of “As Is” and “As Available” for your use at your own risk basis without representations or warranties of any kind, either express, implied or statutory. To the extent permissible pursuant to applicable laws, on behalf of the Indemnified Parties, we expressly disclaim all warranties, express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, design, accuracy, capability, sufficiency, suitability, capacity, completeness, availability or compatibility, or arising from course of dealing or course of performance. We expressly exclude, and you hereby waive any liability on the part of the Indemnified Parties for any special, indirect, direct, incidental, consequential or punitive damages or any other damages whatsoever, including but not limited to loss of profits, data, income, revenue, business, contracts, savings or anticipated savings, goodwill or cost of cover, or wasted management, business, personal or office time, arising out of or relating to the Site, the Application or the Content, and whether caused in whole or in part by negligence, acts of god, telecommunications failure, theft, destruction or any other reason.

RELEASE of ACTIVITIES

The term “activities” includes but is not limited to the use of resort equipment and all outdoor activities relating to all water sports, boating, canoeing, kayaking, fishing, swimming, water trampoline, beach area, all areas of walking, hiking, children’s playground, sports courts, tobogganing, skating, ice hockey, ice fishing, cross-country skiing, snowshoeing, and all other outdoor activities offered by this Resort for this release.

That all guests understand that the activities made available by and at this resort may be considered inherently dangerous and may cause serious injuries or death including damage to personal property. The understanding that these risks, dangers, and/or injuries may be due to inclement weather, slipping, falling, carelessness, horseplay, inadequate or defective equipment, and all other circumstances inherent to recreational activities.

That all guests on behalf of themselves and those to whom they are responsible for under their booking and take full responsibility and waive any claims of personal injury, death, or damage to personal property associated with use of the Resort and all the activities available. In doing so, you (the guest)/we hereby Waive and Release, indemnify, hold harmless, and forever discharge Maxion Blue Spruce Resort Limited Partnership and its agents, employees, officers, directors, and affiliates of all claims, relating to injury, death and or losses of every kind and nature, whether known or unknown.

FORCE MAJEURE

The Resort accepts no liability of any compensation where the performance and obligations is prevented, affected directly or indirectly as a result of force majeure or any circumstances beyond its reasonable control including, but not limited to, flood, earthquake, extreme adverse weather conditions, natural disasters, other acts of God, acts of terrorism, fire or failure of electric power, gas, water, or other utility service, plant machinery, computers, vehicles or any collapse of building structures.

PARKING

The resort offers on-site parking for guests. Vehicles, trailers, off-road vehicles, boats, snowmobiles, and their contents are left at the owner’s/guest’s own risk. We do not accept responsibility for loss or damage, however caused.

CANCELLATION POLICY

We understand that circumstances can sometimes change, and it can be difficult to commit to advanced bookings. Due to the nature of the resort industry, the following cancellation policy applies:

Please note that once guests check in for their reservation, if a guest decides to shorten their stay for any reason, refunds will not be available.
